Terms of Service

Welcome to Triviolt. These Terms of Service ("Terms") govern your access to and use of the Triviolt platform, including our website, applications, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Service Description

Triviolt is an educational quiz and trivia platform designed for learners of all ages, from toddlers through adults. The Service provides interactive quizzes across 700+ categories spanning education, business, sports, and entertainment. Features include adaptive difficulty, spaced repetition, progress tracking, achievements, and family profile management.

2. Eligibility and Accounts

You must be at least 13 years of age to create an account on Triviolt. Children under 13 may use the Service only under a parent or legal guardian's account through the Family Plan family member profile feature. By creating an account, you represent that you are at least 13 years old or that you are a parent or legal guardian creating an account on behalf of your family.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. If you are a parent or guardian, you are responsible for your child's use of the Service under your account.

3. Content Accuracy & Educational Disclaimer

All quiz content, answers, and educational materials provided through the Service are for entertainment and general educational purposes only. The Service is not aligned with, endorsed by, or a substitute for any official school curriculum, standardized test, or academic program.

Quizzes and educational materials may contain errors, inaccuracies, or outdated information. Triviolt makes reasonable efforts to ensure accuracy but makes no guarantees regarding the correctness, completeness, or currentness of any content.

Triviolt shall not be liable for any reliance on quiz content for academic, professional, or any other decisions. You acknowledge that the Service should not be used as your sole source of information for any purpose.

4. User-Generated Content

The Service allows you to create, upload, and share content such as custom quizzes, flashcards, and other materials ("User Content"). You retain ownership of your original User Content.

By uploading or creating User Content on the Service, you grant Triviolt a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from your User Content in any form, medium, or technology now known or later developed, for any purpose, including but not limited to operating and improving the Service, creating new features, training systems, and marketing.

You represent and warrant that you have all necessary rights to grant this license and that your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.

Triviolt may review, modify, or remove any User Content at its sole discretion, for any reason and without notice.

5. Subscription Plans and Pricing

Triviolt offers the following subscription tiers:

• Free Plan: Access to a limited selection of categories in each section. Free forever with no payment required.
• Solo Plan: Full access to all 700+ categories for a single learner. Billed annually. See the Pricing page for current pricing.
• Family Plan: Full access to all categories plus up to 5 family member profiles with individual progress tracking. Billed annually. See the Pricing page for current pricing.
• Party Plan: Everything in Family plus live multiplayer, polls, surveys, word maps, and a template library. Billed annually. See the Pricing page for current pricing.
• Classroom Plan: Everything in Party plus educator tools and flexible student profiles. Custom pricing — contact us for details.

New customers who subscribe to an annual plan receive a 7-day free trial. You will not be charged during the trial, and you may cancel at any time before the trial ends to avoid any charge. Monthly plans are billed immediately and are not eligible for the free trial.

Triviolt reserves the right to modify subscription plans, pricing, features included in each tier, and the availability of the free plan at any time. Changes to your current subscription will take effect at your next billing cycle.

6. Rewards, Streaks & Promotions

Rewards, streaks, badges, achievements, points, or promotional incentives offered through the Service have no monetary or redeemable value unless explicitly stated otherwise.

Triviolt reserves the right to modify, suspend, or discontinue any rewards program, promotion, or incentive at any time without prior notice or liability.

Accumulated rewards, points, or other virtual items may be adjusted or reset at Triviolt's sole discretion.

7. Billing and Auto-Renewal

Paid subscriptions are billed annually and renew automatically at the end of each billing period unless canceled before the renewal date. By subscribing to a paid plan, you authorize Triviolt (via our payment processor, Stripe) to charge your payment method on file for the applicable subscription fee at the beginning of each billing cycle.

Prices are stated in US Dollars and may be subject to applicable taxes depending on your jurisdiction. Triviolt reserves the right to change subscription pricing with at least 30 days' advance notice. Price changes will take effect at the start of your next billing cycle.

8. Cancellation and Refunds

You may cancel your subscription at any time through the Stripe Customer Portal accessible from your profile page. Upon cancellation:

• Your access to paid features will continue until the end of your current billing period.
• You will not be charged for subsequent billing periods.
• No prorated refunds are provided for the remaining portion of your current billing period.
• Your account will revert to the Free Plan at the end of the billing period.
• All your data, scores, and progress will be preserved.

9. EU Right of Withdrawal

If you are a consumer residing in the European Union or the European Economic Area, you have the right to withdraw from your subscription within 14 days of your initial purchase without providing any reason (the "cooling-off period"). To exercise this right, contact us at [email protected] within 14 days of your purchase date. We will process a full refund to your original payment method within 14 days of receiving your withdrawal request. This right applies only to the initial subscription purchase and not to subsequent renewal periods.

10. Acceptable Use

You agree not to:

• Use automated tools, scripts, or bots to interact with the Service
• Exploit bugs or vulnerabilities to gain unfair advantages in quizzes or leaderboards
• Share your account credentials with others or allow unauthorized access to your account
• Exceed the profile limits of your subscription plan (e.g., creating more than 5 family member profiles on a Family Plan)
• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Harass, abuse, or submit offensive content through any user-facing feature
• Circumvent or interfere with the Service's security measures or access controls

11. Intellectual Property

All quiz content, questions, educational materials, graphics, branding, and software comprising the Service are owned by Triviolt or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

You retain ownership of your personal data (display names, scores, progress). For any content you create or upload (custom quizzes, flashcards, etc.), the license terms in Section 4 (User-Generated Content) apply.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRIVIOLT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

TRIVIOLT'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO TRIVIOLT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TWENTY US DOLLARS ($20), WHICHEVER IS GREATER.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, TRIVIOLT MAKES NO WARRANTY THAT QUIZ CONTENT, ANSWERS, OR EDUCATIONAL MATERIALS ARE ACCURATE, COMPLETE, OR CURRENT. YOU ACKNOWLEDGE THAT QUIZZES MAY CONTAIN ERRORS AND AGREE NOT TO RELY ON THE SERVICE AS YOUR SOLE SOURCE OF INFORMATION FOR ACADEMIC, PROFESSIONAL, OR ANY OTHER PURPOSE.

13. Modifications to the Service

Triviolt may modify, update, or discontinue any feature, content, category, game mode, or aspect of the Service at any time without obligation or liability. This includes, without limitation, adding, removing, or changing quiz content, categories, difficulty levels, game modes, and any other functionality.

No prior notice is required for content changes. For material changes to features, Triviolt will make reasonable efforts to provide advance notice through the Service.

14. Termination

Triviolt reserves the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users or the Service, or is otherwise objectionable. Upon termination for cause, your right to use the Service ceases immediately, and no refund will be provided.

You may delete your account at any time by contacting us at [email protected]. Upon account deletion or termination, Triviolt may delete all associated data — including scores, progress, custom content, and family profiles — and has no obligation to preserve it. Personal data will be handled in accordance with our Privacy Policy.

15. Dispute Resolution

If you have a dispute with Triviolt, we encourage you to contact us at [email protected] so we can attempt to resolve the matter informally. The parties agree to first attempt to resolve any dispute through good-faith negotiation for a period of at least 30 days.

If informal resolution is not successful, any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, with the arbitration to be held in the State of North Carolina, USA. The arbitrator's decision shall be final and binding. You agree to waive the right to participate in class action lawsuits or class-wide arbitration.

Notwithstanding the foregoing, nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States of America, without regard to its conflict of law provisions. For matters not subject to arbitration, the exclusive jurisdiction and venue shall be the state and federal courts located in North Carolina.

17. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will provide notice through the Service or by other appropriate means. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
